The protection of your personal data is a priority for Your Trusted Guide (YTG). Below, we describe who we are, for what purposes we may use your personal data, how we treat it, with whom we share it, how long we keep it, and how you can contact us and exercise your rights.
Who are we?
Your data is processed by Noites Emolduradas Unipessoal Lda (NIPC 518286290), registered at Praceta Francisco Borges, n.º 31, R/C Esq. Frente, 4200-310 Porto, Portugal, operating under the brand Your Trusted Guide (YTG) (“YTG”, “we”, “us”).
YTG is the data controller within the meaning of the General Data Protection Regulation (GDPR).
Why do we process your information?
Your personal data may be collected and processed by YTG for the following purposes:
- To comply with legal obligations to which YTG is subject, in particular communications to the foreign and border authorities (SIBA / AIMA) and invoicing and tax obligations.
- For the performance of the temporary accommodation contract with the guest, including payment transactions, check-in / check-out management, guest management, security deposit management, and the provision of complementary services (cleaning, transfers, etc.).
- For mobile and email communications, marketing communications, and responses to information requests, based on the guest's consent.
- For the protection of property and assets held by YTG, and for statistical analysis purposes, based on YTG's legitimate interest.
Failure to provide personal data for the purposes described in the first two points above may prevent YTG from complying with its legal and contractual obligations, and may result in the reservation being cancelled without any right to compensation.
What kind of personal data do we collect?
YTG collects and processes the personal data necessary to provide the contracted services or respond to information requests, namely identification data, contact details, and payment / card data.
Legal basis for processing
Processing is based on the performance of the accommodation contract and compliance with YTG's legal obligations, in particular immigration/border legislation and tax legislation (Article 6(1)(b) and (c) GDPR). Marketing communications are based on consent (Article 6(1)(a) GDPR). Processing for asset protection and statistical purposes is based on YTG's legitimate interest (Article 6(1)(f) GDPR).
How long do we keep your information?
Personal data is kept only for the minimum period necessary for the purposes that motivated its collection, subject to applicable legal, regulatory or judicial requirements.
Who do we share your personal data with?
YTG may share personal data with:
- Affiliated companies or partners, provided they respect an equivalent data protection standard.
- Public entities to which YTG is legally required to report information, in particular AIMA (Agência para a Integração, Migrações e Asilo) and the Autoridade Tributária e Aduaneira (Portuguese Tax Authority).
- Subcontractors providing services on YTG's behalf, such as booking / property management platforms, payment processors, hosting providers, cleaning companies, accountants and insurers.
- Competent authorities where legally required, such as judicial entities or supervisory authorities.
Is your data transferred outside the European Union?
As a rule, your personal data is not transferred outside the European Union. Exceptionally, and subject to appropriate safeguards under the GDPR, data may be transferred outside the EU for hosting, technical processing, or backup purposes. YTG will not transfer your data to countries that do not guarantee an adequate level of protection under the GDPR.
What are your rights?
You may, at any time, request access to your personal data, its rectification or erasure, restriction of processing, object to processing, and request data portability, in accordance with the GDPR. Where processing is based on consent, you may withdraw that consent at any time, without affecting the lawfulness of processing carried out before its withdrawal. You also have the right to lodge a complaint with the CNPD (Comissão Nacional de Proteção de Dados).
Security and confidentiality
YTG uses appropriate technical and organisational measures to protect your personal data. However, no transmission of data over the internet can be guaranteed to be completely secure. YTG does not sell, rent or commercially disclose your personal data to third parties, and undertakes to keep it confidential in accordance with this Privacy Policy and applicable law.
